Terms and conditions of using the store
1. Entrepreneur, contact
1.1. The entity running the online store via the Internet, operating at https://www.proaboshop.pl, is the Period Foundation. based in Przasnysz, ul. 3 Maja 16 3 (hereinafter referred to as "Period"), entered into the Register of Entrepreneurs of the National Court Register kept by the District Court of Białystok, 12th COMMERCIAL DEPARTMENT OF THE NATIONAL COURT REGISTER under KRS number: 0000953898, with REGON: 521266252, NIP: 761 156 73 95.

2. General rules of using the Period Foundation online store
2.1. The online store can only be used by persons over 16 years of age.
2.2. People registering in the online store and making purchases there provide their personal data, which LPP processes in accordance with the principles set out in the Privacy Policy.
3. Ordering goods
3.1. Orders are accepted via the website https://www.proaborshop.pl
3.2. The goods in the online store are marked in detail. The store's website contains, among others, information about the properties of the product, its price and the material it is made of.
3.3. When ordering goods, the customer selects them in a manner appropriate to the given item, specifying in particular the size, color, number of pieces and, if necessary, also providing other specific information and the number of pieces of the ordered goods.
4. How to buy in the online store - detailed instructions
4.1. After the customer has selected the product in a given size, click the "Add to cart" icon.
4.2. The product is transferred to the basket, which is visible in the upper right corner of the page. After selecting the "Proceed to place order" option, if you are not logged in yet, you will be transferred to the login / account creation panel.
4.3. Then, a page will open where you must enter the Customer's data necessary to complete the transaction and ship the ordered goods.
4.4. After creating an account / logging in, the Customer gains access to additional options in the Customer panel, such as: order history, the ability to check the status of the last placed order, remembering shipping addresses, and the ability to receive current information about products from the store.
4.5. After selecting one of the delivery methods available at the time of placing the order and entering all the necessary data (including possibly invoice data), select the payment method.
4.6. The customer can choose one of the currently available payment methods in the section - Online payment methods or make a traditional transfer. In justified cases, Period may limit the Customer's access to certain payment methods, but it will not affect the possibility of concluding a contract and making purchases in the online store.
4.7. The customer confirms the order by clicking the "Buy and pay" button
4.8. If the Customer has chosen online payment, after making the payment, the Customer is redirected to the page confirming the order, from which he or she can continue shopping or go to the order summary.
4.9. If Period does not receive the online payment, the order is not considered to have been properly placed, which means that the contract is not concluded and the order will not be completed.
4.10. At each stage of placing an order, until payment is made, you can cancel the order by ceasing to complete the next steps and leaving the ordering subpage. An order whose submission process is not completed by the Customer is considered canceled and will not be processed.
4.11. Immediately after placing the order, an e-mail confirming the order will be sent to the Customer's e-mail address provided in the login details. In this message, the Customer will receive an individualized order number, which allows, among others: determining the status of the order.
4.12. Period may contact the Customer at the e-mail address provided by the Customer or by phone, at the contact telephone number provided by the Customer, in order to clarify doubts, confirm the order or in any other matters related to the order.
5. Prices
5.1. Prices on the online store website given in Polish zloty are gross prices, including VAT.
5.2. The price of the goods includes shipping costs, the amount of which depends on the selected form of delivery and payment.
5.3. The price given on the website at the time of placing the order is the final price, binding both the Customer and Period Foundations. After placing the order, the price of the ordered goods will not change, regardless of any price changes introduced by Period or any promotional or sales campaigns initiated.
5.4. Period reserves the right to change the prices of goods available in the online store, introduce new goods for sale, conduct and cancel promotional campaigns on the store's websites, or make changes to them.
6. Availability of ordered goods
6.1. All goods offered in the online store are available goods.
6.2. In exceptional situations, e.g. when many Customers place an order for the same product at the same time, it may happen that the product will not be available. In such a situation, the Customer will be informed that it is impossible to complete the order.
6.3. The product card provides full information about the range of available sizes.
7. Inability to complete the order
7.1. If a given product is out of stock or it is impossible to complete the order for another reason, the Customer will be informed by e-mail or telephone. In particularly justified cases, Period may refuse to conclude a sales contract in order to protect its goods.
7.2. In the event that, beyond Period's control, it is impossible to deliver the order to the collection point indicated by the Customer (due to e.g. unavailability of the selected point or exceeding the dimensions of the package), Period reserves the right to use the data provided for the invoice or another alternative address, if provided for delivery, to deliver the shipment. placing an order.
8. Delivery method and order processing time
8.1. Deliveries of goods are made within Poland and outside Poland.
8.2. If you choose one of the online payment methods, the order is processed after confirmation of payment for the ordered goods.
8.3. If the selected goods are available and the Customer has chosen the delivery method, the delivery time is from 1 to 14 business days from the date of effective order placement.
8.4. Delivery times may be extended during sales or special promotion periods.
8.5. NOTE: If you choose one of the currently available online payments as the payment method, the order processing begins after receiving 100% of the amount due for the order, and from that moment the time within which the goods will be handed over to the Customer should be counted.
8.6. Orders are delivered by a courier company selected by Period.
8.7. Fundacja Period may periodically and at no additional cost to the Customer (other than those indicated in the Regulations) provide the delivery options "buy today, collect tomorrow" or "buy today by 3 p.m., collect tomorrow", which means that most of the purchases ordered in this option will be transferred to be collected by the Customer within 24 hours of ordering, however this is not guaranteed by Period. This option may only be available on courier delivery orders.
9. Forms of payment for the order
9.1. Cash on delivery: option not available
9.2. Transfer: only online transfers made using the payment method selected by the Customer, i.e. the website of one of the Period Foundation's partners, are available. After making the selection, the Customer is safely redirected to the website of the payment operator of his choice. The payment operation is made between the customer and the selected payment operator.
9.3. Fundacja Period accepts traditional transfers, so the customer will receive an account number to which the payment should be made, e.g. at a bank or post office.
9.4. In order to offer the Customer deferred payment methods, during the purchase process, we may transfer the Customer's personal data in the form of contact details and order details to companies dealing with given services in order for them to assess whether he/she qualifies for the offered deferred payment methods and to adapt these methods to the client. The personal data provided are processed in accordance with the privacy policy of the payment operator selected by the Customer, i.e. Paypo's privacy policy or Klarna's privacy policy.
9.5. Payment card: if the Customer is the holder of a card enabling making payments on the Internet (check with the bank that issued the card whether a given card meets this condition). Payment by payment card is made through the Period partner selected by the Customer. The payment operation is made between the customer and the operator of the card held by the customer.
9.6. Attention! The Online Store will never send the Customer a message informing that the payment account has changed, along with a request to make a traditional transfer. If the Customer receives such an e-mail, he or she should not make a payment or respond to it, but should send an unchanged e-mail to the Period Foundation at the following address: sklep@fundacjaperiod.pl.
10. Sales contract
10.1. The information posted on the store's website https://www.proaboshop.pl does not constitute an offer to conclude a contract in accordance with the provisions of the Civil Code, which means, among other things, that Period may refuse to conclude a contract in particularly justified cases, in particular to protect its goods.
10.2. The contract is concluded in Polish.
11. Performance of the contract - deadline
Depending on the type of delivery option selected by the Customer, Period undertakes to deliver the goods to the Customer for collection within 1 to 14 business days from the date of successful submission of the order. If you choose delivery to a parcel machine, collection point or collection point in the showroom, the delivery time is the time the parcel is placed in the parcel machine, delivered to the collection point or showroom.
If the goods are out of stock or it is impossible to complete the order for another reason, Period will immediately contact the customer and propose possible solutions in the given situation. Working days are counted from Monday to Friday, excluding public holidays.
12. Delivery cost
12.1. Deliveries are made within Poland and outside Poland.
12.2. The delivery cost depends on the selected delivery and payment method available at the time of purchase.
13. Withdrawal from the contract
13.1. The customer has the right to withdraw from the contract of sale of goods without giving any reason (so-called return of goods).
13.2. The right to withdraw from the contract expires after 30 days from the date on which the Customer came into possession of the goods or on which a third party other than the carrier and indicated by the Customer came into possession of the goods.
13.3. To exercise the right to withdraw from the contract, the Customer submits to Period an unambiguous declaration of withdrawal from the contract in one of the indicated ways:

- by sending an e-mail to: sklep@fundacjaperiod.pl
- by printing, completing and sending the sample withdrawal form available on the online store website in the "Contract Withdrawal Form" tab - however, this form is not obligatory
- by completing and sending the online form, available in the Customer panel for each order; If this form is used, the Customer immediately receives confirmation that Period has received his declaration of withdrawal from the contract.
Attention! Each method of sending a statement is acceptable and all are equivalent in terms of effectiveness. Period only recommends using the online form available in the Customer panel solely due to the ease and speed of submitting the declaration.
13.4. In order to meet the deadline for withdrawal from the sales contract, it is sufficient for the Customer to send information regarding the exercise of the Customer's right of withdrawal before the expiry of the 30-day period referred to in point 13.2. above.
13.5. In the event of withdrawal from the sales contract, Period returns the received payments to the Customer, including the costs of delivering the goods to the Customer (except for additional costs resulting from the delivery method chosen by the Customer other than the cheapest standard delivery method offered by LPP), no later than 14 days from the date , in which Period was informed about the Customer's decision to exercise the right to withdraw from the sales contract, subject to point 13.7. below.
13.6. The refund will be made using the same payment methods that were used by the Customer in the original transaction, unless the Customer expressly agrees to a different solution. In any case, the Customer will not incur any fees in connection with the refund in any way other than the method of payment for the goods.
13.7. Period may withhold the refund until the returned item is received and inspected.
13.8. Items should be sent to the following address: Fundacja Period, ul. 3 Maja 16, 06-300 Przasnysz, immediately, and in any case no later than 14 days from the date on which the Customer informed Period about the withdrawal from the sales contract. The deadline is met if the Customer returns the item before the 14-day deadline expires.
13.9. The customer is obliged to bear the direct costs of returning the items.
13.10. The customer may use the paid option of returning items via courier, including through parcel machines or the so-called collection points, via Period, if Period offers such a possibility at a given time. If the Customer chooses the paid return method currently offered by Period, the cost of the shipping option selected by the Customer will be deducted from the refund amount due to the Customer. This means that the amount due to the Customer for returning the goods will be reduced by the cost of this shipment.
13.11. The customer is responsible for any reduction in the value of the item resulting from using it in a manner other than necessary to establish the nature, characteristics and functioning of the item.
14. Complaints
14.1. The subject of sale are new products, in a condition suitable for use in accordance with their intended purpose. Period is responsible for the compliance of the goods with the contract.
14.2. Any item purchased in the Pro Abo Shop online store may be subject to a complaint if the Customer finds that it is inconsistent with the contract, if this inconsistency becomes apparent within two years of its delivery to the Customer.
14.3 The customer may request that the complained item be repaired or replaced with a new item in accordance with the contract. If the method chosen by the Customer to bring the goods into compliance with the contract turns out to be impossible or involves excessive costs for Period, Period may bring the goods into compliance with the contract by repair and replacement or by replacement in place of the repair requested by the Customer.
14.4. If both the repair and replacement of the goods prove ineffective, the Customer may submit a declaration of withdrawal from the contract or demand a reduction in the price of the complained goods.
14.5. Taking into account the Customer's convenience, Period offers, beyond the rights indicated in point 14.3. the possibility of withdrawing from the contract as a third, additional right of the Customer related to the non-compliance of the goods with the contract, which may be reported during the first complaint about the goods. The right of withdrawal may be exercised by the Customer within two years from the date of delivery of the goods. This provision does not affect the consumer's statutory rights related to non-conformity of the goods with the contract.
14.6. Complaints can only be submitted by post.
14.7. In the case of a complaint by post, please provide the reasons for the complaint and information necessary to identify the order. To submit a complaint, you can use the "Complaint" form recommended by Period (available on the website, in the Customer panel, for each order), which can be completed online or printed, and then send the goods to the following address: Fundacja Period ul. 3 maj 16 06-300 Przasnysz
14.8. Period enables Customers who file a complaint to return the defective goods by courier at the expense of the Period Foundation. For this purpose, the Customer is required to complete an electronic complaint form (available in the Customer panel) with the address details from where the courier should collect the parcel with the complained products.
14.9. Period will consider the complaint within 14 days and inform the Customer about how it was resolved via e-mail or text message.
14.10. If a complaint submitted by post is positively considered, the Customer will receive a refund for the goods and a refund of the incurred, specific costs of sending the defective goods to the e-shop - after sending a copy/scan of proof of their incurrence to the e-mail address: sklep@fundacjaperiod.pl
14.11. If the complaint is considered positively, the amount of money due to the Customer, together with any refund due, will be returned to the Customer's bank account provided in the complaint form.
14.12. If a complaint sent by post or LPP courier is not accepted, the Customer will receive information about the reasons for not accepting the complaint to the e-mail address included in the order and the goods will be sent back to the address from which the complaint was sent.
15. Order Cancellation
The customer has the option of canceling the order themselves, within fifteen minutes of placing the order, in the customer panel, in the "My orders" tab, by clicking the "Cancel order" button for a given order.
16. Issuing an invoice
16.1. When requesting an invoice, the Customer provides the necessary data, and the NIP number for the invoice must be provided no later than when placing the order.
16.2. Period is not responsible for the Customer providing incorrect or incomplete invoice data.
16.3. In the case of corrective invoices, these Regulations constitute documentation agreeing the conditions of correction within the meaning of Art. 29a section 13 of the Act of March 11, 2004 on tax on goods and services and the client's acceptance that the moment of reducing the amount of VAT charged in the settlement for a given period is the moment of issuing a corrective invoice by the Period Foundation. Period issues a correction invoice upon the return of the goods to Period, which constitutes the fulfillment of the conditions for issuing a correction invoice.
17. Processing of personal data
In order to maintain the User's account and conclude and perform sales contracts, as well as perform the seller's obligations resulting from the conclusion of distance sales contracts, the Period Foundation processes the Customer's personal data, which the Customer provides voluntarily.
